Continued use of the Platform after changes constitutes acceptance of them.

5. PLATFORM SUSPENSION OR DISCONTINUATION

We do not guarantee uninterrupted availability.

Fomo FZ-LLC may suspend or discontinue the Platform for reasons that are:

7. LICENCE TO USE

Fomo FZ-LLC grants you a licence that is:

The following are not permitted:

• sale;
• commercial use without authorisation;
• reverse engineering;
• scraping;
• the use of bots;
• automated data collection.

8. PROHIBITIONS AND UNLAWFUL ACTIVITIES

Fomo FZ-LLC enforces strict policies against fraud, money laundering, terrorist financing and criminal activity.

We reserve the right to:

• verify the identity of users;
• request KYC documents;
• request business licences;
• request proof of ownership;
• suspend transactions;
• restrict accounts;
• report suspicious activity to the competent authorities.

The Platform may not be used by:

• sanctioned persons;
• criminal organisations;
• entities on OFAC, EU or UN lists;
• users who violate international laws.

It is prohibited to publish, sell, promote or distribute:

8.1 Unlawful goods or services

Including:

• firearms;
• ammunition;
• explosives;
• drugs;
• narcotic substances;
• false documents;
• counterfeit currency;
• stolen goods;
• counterfeit products;
• fraud equipment;
• malware;
• spyware;
• contraband goods.

8.2 Prohibited content

Including:

• pornography;
• sexual exploitation;
• human trafficking;
• prostitution;
• terrorist content;
• extremism;
• hate speech;
• discrimination;
• violence;
• threats;
• harassment;
• financial scams;
• pyramid schemes;
• money laundering.

8.3 Prohibited activities

The following are prohibited:

• defrauding users;
• impersonation / false identity;
• spam;
• phishing;
• price manipulation;
• publishing fake listings;
• listing property or vehicles that do not exist;
• using the Platform for criminal activity.

Fomo FZ-LLC reserves the right to:

• remove any listing;
• suspend accounts;
• report to authorities;
• cooperate with law-enforcement bodies.

9. REPORTING UNLAWFUL CONTENT

Fomo FZ-LLC operates as a digital intermediary platform and does not pre-verify or approve all listings.

We do however implement:

• notice-and-takedown;
• moderation;
• verification;
• appeal;
• abuse-reporting mechanisms.

Any user may report unlawful or abusive content at:

Fomo FZ-LLC may:

• immediately remove the content;
• restrict access;
• close the account;
• preserve evidence;
• report to the competent authorities.

10. ACCOUNT CREATION

Fomo FZ-LLC may at any time request:

• identity verification;
• personal documents;
• business registration;
• VAT number;
• proof of address;
• ownership documents.

Failure to provide requested documents may result in:

• suspension;
• restriction;
• closure of the account.

Users must provide information that is:

• accurate;
• complete;
• up to date.

You are responsible for:

• account security;
• safeguarding the password;
• any activity on your account.

11. PAID SERVICES

Some functionality may be paid.

All fees:

• are clearly displayed;
• are non-refundable except where required by law.

Fomo FZ-LLC does not guarantee:

• sales;
• rentals;
• contacts;
• earnings;
• commercial success.

12. LISTINGS

Sellers must:

• have the legal right to sell;
• be the lawful owner;
• publish accurate information;
• comply with the law.

The following are prohibited:

• publishing fraudulent listings;
• using fake photographs;
• selling counterfeit goods;
• multiple spam listings.

13. PROPERTY AND REAL ESTATE

Agents and developers must:

• hold valid licences;
• comply with the law;
• publish only real properties;
• provide truthful information.

Fomo FZ-LLC does not act as a real-estate agent.

14. VEHICLES

Vehicle sellers must:

• be the lawful owner;
• hold valid documentation;
• publish accurate descriptions.

Fomo FZ-LLC may request:

• proof of ownership;
• customs documents;
• identity verification.

15. EMPLOYMENT

Employers must:

• publish real job offers;
• not discriminate;
• respect employment laws.

The following are prohibited:

• defrauding candidates;
• requesting unlawful payments;
• publishing fake jobs.

16. USE OF ARTIFICIAL INTELLIGENCE

Fomo FZ-LLC may offer AI features to help with creating listings.

The user remains fully responsible for:

• accuracy;
• legality;
• content;
• verification.

17. REVIEWS AND RATINGS

Reviews must be:

• genuine;
• accurate;
• non-defamatory;
• non-abusive.

Fomo FZ-LLC may remove any review that violates the law or these Terms.

18. INTELLECTUAL PROPERTY

All rights in:

• the Platform;
• the code;
• the design;
• the logos;
• the trademarks;
• the content

are owned by Fomo FZ-LLC or its licensors.

19. LIABILITY

Fomo FZ-LLC is solely a technology intermediary platform.

We are not:

• a seller;
• an agent;
• a distributor;
• a financial intermediary;
• an employer;
• a tour operator;
• a real-estate agent.

Users are fully responsible for:

• listings;
• transactions;
• legality;
• taxes;
• VAT;
• customs;
• licences;
• the content they publish.

Fomo FZ-LLC does not guarantee:

• the authenticity;
• the quality;
• the safety;
• the legality of listings.

Fomo FZ-LLC is not liable for:

• transactions between users;
• user fraud;
• indirect damages;
• loss of profit;
• loss of data;
• content published by users.

The Platform is provided "as is".

20. LIMITATION OF LIABILITY

To the maximum extent permitted by law, the total liability of Fomo FZ-LLC shall not exceed:

• the amount paid by the user; OR
• EUR 1,000.

21. ACCOUNT CLOSURE

Fomo FZ-LLC may:

• suspend;
• restrict;
• close accounts;
• block IPs;
• block devices;
• refuse account recreation.

This applies especially in cases of:

• fraud;
• fake listings;
• criminal activity;
• money laundering;
• repeated violations.

Fomo FZ-LLC may retain:

• IP addresses;
• logs;
• communications;
• metadata;
• transaction history

as electronic evidence in accordance with the law.

Fomo FZ-LLC may suspend, restrict or close any account that violates:

• the law;
• these Terms;
• Platform security.

22. FORCE MAJEURE

Fomo FZ-LLC is not liable for delays or failures caused by:

• war;
• natural disasters;
• cyber attacks;
• technology outages;
• government decisions;
• events outside reasonable control.

23. APPLICABLE LAW

These Terms are governed by the laws of:

Dubai International Financial Centre (DIFC)

Any dispute shall be resolved exclusively by the courts of the DIFC.

24. LANGUAGE

The official version of these Terms is in English.

The Albanian version is provided for convenience.

In the event of any inconsistency, the English version shall prevail.

25. ELECTRONIC COMMUNICATIONS

By using the Platform, you accept receiving:

• email;
• SMS;
• OTP;
• push notifications;
• legal notices;
• security communications.

All electronic communications are considered legally valid.

26. ARTIFICIAL INTELLIGENCE

AI features may generate:

• errors;
• inaccuracies;
• incomplete content.

The user is fully responsible for verifying any information generated by AI.

Fomo FZ-LLC is not liable for damages caused by use of AI-generated content.

27. INTELLECTUAL PROPERTY RIGHTS AND CONTENT REMOVAL

Fomo FZ-LLC respects intellectual property rights.

We may:

• remove content;
• suspend accounts;
• close repeat infringers;
• request proof of ownership;
• cooperate with the authorities.

28. APPLICABLE LAW AND JURISDICTION

These Terms are governed by the laws of the Dubai International Financial Centre (DIFC).

Any dispute shall be resolved exclusively by the courts of the DIFC.

Nothing in these Terms limits the mandatory rights of consumers that apply under mandatory local laws.

29. ACCEPTABLE-USE POLICY

Users must not:

• use the Platform for criminal activity;
• publish fraudulent content;
• use false identities;
• circumvent security systems;
• manipulate ratings;
• publish malware or harmful code;
• use scraping or bots;
• interfere with Platform operation.

30. PROHIBITED PRODUCTS AND SERVICES POLICY

It is prohibited to publish or promote:

• weapons;
• ammunition;
• explosives;
• drugs;
• narcotics;
• sexual services;
• pornography;
• counterfeit products;
• false documents;
• stolen goods;
• contraband products;
• tobacco products;
• vapes;
• prescription medicines;
• hazardous products;
• pyramid schemes;
• financial scams;
• fraudulent cryptocurrencies;
• protected animals;
• products that are unlawful under local or international law.

Fomo FZ-LLC may immediately remove any such listing without notice.

31. SELLER VERIFICATION POLICY

Fomo FZ-LLC may offer "Verified Seller" status.

For verification, the following may be requested:

• identity document;
• business licence;
• VAT;
• ownership documents;
• proof of address;
• banking documents.

Verified status:

• may be removed at any time;
• does not guarantee absolute trustworthiness;
• does not constitute a guarantee from Fomo FZ-LLC.

32. RULES FOR VEHICLES

Vehicle sellers must:

• publish accurate VIN when requested;
• declare real mileage;
• not conceal accidents;
• not publish stolen vehicles;
• not publish fraudulent listings.

Fomo FZ-LLC may:

• verify documents;
• request proof of ownership;
• remove listings;
• report fraud.

33. RULES FOR REAL ESTATE

Users must:

• have legal authorisation;
• publish real properties;
• avoid fraudulent listings;
• comply with local laws;
• not publish false prices.

Agents and brokers are responsible for:

• licences;
• permits;
• legal compliance.

34. PAYMENTS AND REFUNDS POLICY

Fees paid for:

• promotions;
• advertising;
• subscriptions;
• featured listings

are non-refundable except where required by law.

Fomo FZ-LLC may:

• refuse payments;
• suspend transactions;
• investigate fraud;
• block suspicious payments.

Users are responsible for:

• VAT;
• taxes;
• customs;
• tax filings.

35. COOKIES AND TRACKING TECHNOLOGIES POLICY

The Platform may use:

• cookies;
• analytics;
• Meta Pixel;
• Google Analytics;
• Firebase;
• advertising technologies.

By using the Platform, you accept the use of these technologies in accordance with the Cookies Policy.

36. PROTECTION OF MINORS

The Platform is not intended for persons under 18.

Fomo FZ-LLC may:

• remove minors' accounts;
• request age verification;
• restrict access.

Parents or guardians are responsible for unauthorised use by minors.

37. REPORTING TO AUTHORITIES

Fomo FZ-LLC may:

• cooperate with the authorities;
• hand over data;
• preserve evidence;
• report criminal activity;
• comply with court orders;
• cooperate with regulators.

38. MODERATION APPEAL

Users may request a review of:

• listing removals;
• suspensions;
• restrictions;
• moderation measures.

Fomo FZ-LLC reserves the right to make the final decision.

39. FRAUD WARNINGS

Users must:

• verify the identity of the parties;
• avoid suspicious prepayments;
• check documents;
• report fraudulent activity.

Fomo FZ-LLC does not guarantee the safety of transactions between users.

TERMS FOR VERIFIED BUSINESS

Businesses may apply for "Verified Business" status.

Requirements may include:

• business licence;
• registration documents;
• VAT;
• proof of ownership;
• identity verification.

Fomo FZ-LLC may:

• refuse applications;
• remove the status;
• perform periodic verifications.

The status does not constitute an absolute guarantee.

INSURANCE DISCLAIMER

Fomo FZ-LLC:

• does not guarantee transactions;
• does not guarantee payments;
• does not guarantee quality;
• does not guarantee authenticity.

Users transact at their own risk.

AI MODERATION DISCLOSURE

CLASS ACTION WAIVER

To the extent permitted by law, users agree that disputes will be handled individually and not as part of any class action.

ARBITRATION CLAUSE

Fomo FZ-LLC may elect for disputes to be resolved through arbitration in DIFC or DIAC.

The arbitral award shall be final and binding.

COMPLIANCE LOGS

Fomo FZ-LLC may retain:

• moderation logs;
• security actions;
• investigations;
• reports;
• authority requests;
• electronic evidence.

APP STORE COMPLIANCE

Users must not publish content that violates:

• the Apple App Store Guidelines;
• Google Play Policies;
• advertising rules;
• policies on prohibited content.

Fomo FZ-LLC may remove content for compliance with the platforms.

COMMUNITY GUIDELINES

Users must:

• behave with respect;
• avoid fraud;
• not abuse the platform;
• publish accurate information;
• comply with the law.

The following are prohibited:

• harassment;
• discrimination;
• threats;
• spam;
• fraud;
• manipulation of the platform.

Fomo FZ-LLC may take moderation measures for any violation.
